A federal appeals court has ruled that former President Donald Trump does not have presidential immunity from potential charges from President Joe Biden’s Department of Justice over his alleged election interference in the aftermath of the 2020 election.
In a unanimous decision handed down on Tuesday, Feb. 6, the three-judge panel for the United States Court of Appeals for the District of Columbia Circuit ruled that Trump was not entitled to immunity and can be prosecuted on charges of election interference amid allegations that he attempted to overturn the supposed official results of the 2020 presidential election.
Trump has for years claimed that he was immune from criminal charges in this specific instance because any acts he may have committed fell within his duties as president.
“We cannot accept former President Trump’s claim that a president has unbounded authority to commit crimes that would neutralize the most fundamental check on executive power – the recognition and implementation of election results,” wrote the D.C. Appeals Court in its opinion.
“For the purpose of this criminal case, Former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant,” continued the judges. “But any executive immunity that may have protected him while he served as president no longer protects him against this prosecution.”
The Trump campaign has warned that without presidential immunity, “every future president who leaves office will be immediately indicted by the opposing party.” According to fund manager Louis Navellier of the pro-free markets organization the Freeport Society, this may be the Democrats’ plan all along.
Navellier predicts the Democrats will likely try to jail Trump before November – possibly as early as August.
“The odds are becoming higher by the day that Donald Trump will land in jail. Not because I think he deserves to be there. I don’t. But because the left is hellbent on sending him there,” said Navellier. “And even though there’s no law preventing a convicted felon from serving as president, my bet is that just enough Americans won’t vote for Trump if he’s sitting in jail, such that he won’t be able to win.” (Related: Assassination attempts ON THE RISE around the world – and a target in the United States COULD BE NEXT.)
“To a lot of people, the Democrats are using the justice system to wage ‘legal warfare’ on Trump,” continued Navellier. “Sadly, I think it will work. I hope I’m wrong. But I’m just following the data to its logical conclusion.”
Trump campaign spokesperson Steven Cheung noted in a statement that the former president will be appealing the D.C. court’s decision. This could push Trump’s presidential immunity case up to the Supreme Court, where conservatives hold a supermajority. Trump’s legal team has until Monday, Feb. 12, to file an appeal.
“Without complete immunity, a president of the United States would not be able to properly function,” warned Cheung.
